Basic Collaborative Practice Training

This Two-Day Intensive Training includes a complete introduction to multidisciplinary Collaborative Divorce theory, practice, and skills development as well as ethics and practice development considerations. You will learn how to work within a multidisciplinary team and how the Collaborative Divorce process integrates the roles and functions of all team members to best assist families in their process of restructuring. You will also learn how a multidisciplinary team deals with difficult clients by offering family members the legal, emotional and financial support they need during the divorce process.

Mediation Skills for Collaborative Professionals

This mediation training for collaborative professionals addresses the theoretical, practical, and personal dimensions of integrating an Understanding-based mediative perspective into a Collaborative practice. The overarching goal of this approach to mediation is to find conflict resolution through understanding. Deeper understanding by the parties of their own and each other’s perspective,, concerns and priorities, enables them to find creative and mutually rewarding solutions to their conflict that reflect their personal and economic interests. To that end the mediator meets directly and simultaneously with both parties and, if the parties desire, with their lawyers present as well, to build for each party an understanding of what important to both. We rely heavily on the power of understanding rather than the power of coercion or persuasion to drive the mediation process. We put particular emphasis on the parties’ responsibility in the process and for the decisions that they make together. We want everything to be understood -- from how we will work together, to the true nature of the conflict in which the parties are enmeshed, and how they might free themselves from it. We also believe the parties should understand the legal implications of their case, but that the law should not be the exclusive basis for decision. This means supporting the parties in understanding the needs and interests underlying the dispute that are important to them, to each other and to their family. In order for lawyers to participate in this approach requires that they shift from a stance of adversary advocacy to one of collaborative support and embracing a focus that includes but is not limited by the legal framework. This training addresses the practical, theoretical and personal dimensions of how Collaborative professionals can bring this mediative perspective into their practice. Participants learn how to work effectively together in the effort to support the parties in the resolution of their differences in ways that best serve both of them and their family and also how creatively to address the tensions that arise in a Collaborative case. The learning combines presentations, teacher demonstrations and discussions that introduce participants to the five stage model and the principles and tools of the Understanding based approach. Central to the learning are real to life simulations in which the participants work through a mediation from beginning to end with each participant having the opportunity to role-play, in turn, mediator and party. This provides the chance to apply the concepts and skills introduced and to experience the emotional challenges faced by parties in working together to resolve their conflict.
